Sharegain Limited (“Sharegain”, “us”, “our” or “we“) owns and operates a public website as well as our hosted products and solutions which are restricted to authorised users. We are registered with the Information Commissioner (No. ZA289509), and are authorised and regulated by the Financial Conduct Authority (No. 730395).

For the purposes of the Data Protection Act 2018 and General Data Protection Regulation (EU) 2016/679, as amended from time to time (“GDPR”), we are the data controller of any data we hold that may be used to identify you (“Personal Information”).

This Privacy Policy sets out the data processing practices in relation to Personal Information and data which is collected and retained by us. Protecting your data, privacy and financial details is very important to us. We are keen to strike a fair balance between your personal privacy and ensuring that you obtain maximum value from our services and other products and services which may be of interest to you. With regards to each of your visits to our website we may automatically collect the following information: (a) technical information, including the internet protocol (IP) address used to connect your computer to the internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform and use of cookies; (b) information about your visit, including the full uniform resource locator (URL) click stream to, through and from our website (including date and time); what you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks and mouse overs), and methods used to browse away from the page and any phone number used to call our customer service number.

We may receive information from the banks and other financial institutions you are using to manage or hold your investments.

Use of information collected

Sharegain uses your personal details provided and information from our website for the purpose of: (a) satisfying regulatory and legal requirements; (b) providing and personalising our services to ensure that our offering is tailored to your needs and interests as much as possible; (c) as a reference tool or general resource for analysis purposes; (d) to provide you with information about current and future products and services and (e) in order to perform internal ‘Know Your Customer’ and onboarding processes. We keep your information for a reasonable period for these purposes.

Should you ever deactivate your account with us, we will keep your information on file, but only use it to:

  • comply with regulatory requirements;
  • contact you occasionally with the option to reactivate your account; and
  • use your anonymised data for statistical purposes.

We may use the information you provide us to send you SMS or email communications for you to view.

Sharing information

We may share your Personal Information with any member of our group, which means our subsidiaries and affiliates.  We may need to share your information with our service providers, agents and trading counterparts.   • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our customer agreement and any other documents referred to on it; or to protect the rights, property, or safety of Sharegain, our users, or others.
  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
  • We may also use and disclose information in aggregate (so that no individual is identified) for marketing and strategic development purposes.

The safety & security of your Personal Information

We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures that comply with the relevant laws and regulations to help protect your Personal Information from unauthorised access, use, or disclosure. Our cloud-based solution is hosted in highly secure data centres in the European Economic Area (EEA), and adheres to the highest standards of the industry. All communications are encrypted over SSL layer, data is backed up on a regular basis and encrypted at rest. In addition, access to our application layer is secured by Web Application Firewall (WAF) following OWASP core rule sets 3.0, and user communications require Multi Factor Authentication (MFA). Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website or products, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

We have also implemented physical and managerial procedures in order to help safeguard and prevent unauthorised access, use, alteration, modification and/or disclosure of your Personal Information. We restrict access to your Personal Information to those employees of Sharegain who have a business reason for accessing such information. We continuously educate and train our employees about the importance of confidentiality and privacy of customer information.

Although we use reasonable efforts to safeguard the security of your Personal Information, no method of transmission over the Internet or method of electronic storage is 100% secure. Also, any information you provide to us via email or by post is not protected by encryption and is vulnerable to interception during transmission. Where we store your personal data

The Personal Information that we hold will be stored in the EEA, but may be transferred to, and stored at, a destination outside the EEA, by our affiliates or such third parties as outlined in this Privacy Policy (“Sharing Information” section). It may also be processed by staff operating outside the EEA who work for us or for one of our service providers. Such staff maybe engaged in, among other things, the fulfilment of your securities’ loans, the processing of payment details to/from you and the provision of support services.
